How long do I have to make a personal injury claim?
There is a strict 2-year time limit (statute of limitations) for personal injury claims in Ireland. This period runs from the date of the accident or the date you became aware of your injury. Missing this deadline can permanently bar your claim, so it's crucial to seek legal advice promptly.
What is the Injuries Resolution Board?
The Injuries Resolution Board (formerly the Personal Injuries Assessment Board, or PIAB) is the statutory body that assesses most personal injury claims in Ireland. Most claims must first be submitted to the Board before court proceedings can be initiated, and it also offers a mediation service. Assessments are based on the Personal Injuries Guidelines and medical evidence.
How much compensation will I receive for my injury?
Compensation depends on injury severity, the impact on your life, financial losses, and other factors. The Personal Injuries Guidelines, adopted by the Judicial Council, set out the ranges used to assess general damages for different injuries. Your solicitor can advise how the Guidelines may apply to your case after reviewing your medical reports.
What costs can I claim for in a personal injury case?
You can claim for general damages (pain and suffering) and special damages (financial losses). Special damages may include medical expenses, lost earnings, future care costs, travel expenses for medical appointments, and other quantifiable losses related to your injury.
